Sammanfattning:This article examines through the theory and the jurisprudence the situations experienced by Rafael Méndez Valenzuela, who was detained and submitted to process for nearly 13 years, in which he suffered diverse violations to human rights. This case is particularly relevant due to the media's interest that it generated, and since it allows to realize a critical analysis of the way that the right to the due process is determined in the Mexican legal system.
