This work focuses on the study of the victim, where an analysis is made of how the State has conceived it throughout history until it reaches the situation it has in the current legislation. Until today thanks to the constitutional reform on the criminal justice and security system published on June 18, 2008, and the diverse one on human rights of June 10, 2011, which outline the fundamental rights they correspond to the victim of the crime and to the victims of human rights violations, prerogatives that are clearly expressed in the General Law of Victims, and begin to be effective in the new accusatory and oral criminal process. Se analiza que es la víctima, como fue reconocido su papel en el proceso penal, y se estudia el caso particular de México en cuanto al reconocimiento de unas serie de derechos fundamentales que obtuvo a partir de las reformas constitucionales al sistema de justicia y en materia de Derechos Humanos así como los mecanismos de protección con que ahora cuenta. El objetivo de este trabajo se concentró en el estudio de la víctima, donde se hace un análisis de la forma como el Estado la ha concebido a lo largo de la historia hasta llegar a la situación que tiene en la legislación vigente. Gracias a la reforma constitucional sobre el sistema de justicia penal y seguridad publicada el 18 de junio de 2008 y la diversa en materia de derechos humanos del 10 de junio de 2011, en que se perfilan de forma bastante precisa los derechos fundamentales que corresponden a la víctima del delito y a las víctimas de violaciones de derechos humanos, prerrogativas que se plasman con claridad en la Ley General de Víctimas, y se empiezan a hacer efectivos en el nuevo proceso penal acusatorio y oral.
