This article explores whether the respect for Human Rights was fulfilled in the case of women deprived of their liberty in the mexican establishments for executing criminal sanctions, based on the laws contemplated in the legislation of the country and in the international treaties signed by the State.
The paper also describes the historical evolution of human rights, current laws and regulations, and the upsurge of emerging human rights from civil society, essential to protect a community that has evolved and is facing an environment that poses new needs, expectations and challenges.
Based on the data presented in the National Diagnosis of Prison Supervision (DNSP) 2019 issued by the National Human Rights Commission (CNDH), the positions and activities related by the CNDH itself, the Supreme Court of Justice of the Nation (SCJN) and other government agencies as well as findings, proposals and actions resulting from research, visits and interviews (journalistic, international organizations and civil associations) that show quantitative and qualitative issues of prisons in general and women in reclusion in particular. The data was collected in order to reveal: Of committing which crimes women were accused? Under what circumstances were they criminalized? How were they arrested, tried and sentenced? What are the conditions and effects of their detention?
Some cases are reported and, based on the information gathered, we draw up conclusions, proposals and a general call for not remaining indifferent to the problem that arises. And to our Alma Mater, the Autonomous University of Tamaulipas, so that in the noble social commitment privileges attention to this vulnerable group. |

Este artículo es una exploración del cumplimiento del respeto a los derechos humanos de las mujeres privadas de su libertad en los Centros de Ejecución de Sanciones mexicanos, con base en las leyes contempladas en la legislación del país y en los tratados internacionales signados por el Estado. Se describe también la evolución histórica de los derechos humanos, las normas y leyes vigentes y el surgimiento, desde la sociedad civil, de los derechos humanos emergentes, indispensables para proteger a una colectividad que ha evolucionado y está encarando un entorno que le plantea nuevas necesidades, expectativas y retos. A partir de los datos expuestos en el Diagnóstico Nacional de Supervisión Penitenciaria (DNSP) 2019 emitido por la Comisión Nacional de los Derechos Humanos (CNDH), se relacionan las posturas y actividades al respecto de la propia CNDH, la Suprema Corte de Justicia de la Nación (SCJN) y otros organismos gubernamentales, así como hallazgos, propuestas y acciones resultantes de investigaciones, visitas y entrevistas, tanto periodísticas como de organismos internacionales y asociaciones civiles, que muestran aspectos cuantitativos y cualitativos de los centros penitenciarios en general y de las mujeres en reclusión en particular a fin de conocer ¿De qué delitos fueron acusadas? ¿Bajo qué circunstancias delinquieron? ¿Cómo fueron detenidas, juzgadas y sentenciadas? ¿Cuáles son las condiciones y efectos de su reclusión? Se relatan algunos casos y a partir de la información recabada se elaboran conclusiones, propuestas y un llamado general a no permanecer indiferentes a la problemática que se plantea. Y a nuestra Alma Mater, la Universidad Autónoma de Tamaulipas, para que en su noble compromiso social privilegie la atención hacia este grupo vulnerable.
