For the Mexican State to guarantee the issuance of fair and equitable sentences, it is necessary to guarantee compliance with a series of budgets in the development of jurisdictional activity, among which the need to achieve specialization of judges and magistrates stands out. and provide them with the opportunity for permanent training appropriate to the work they perform. Likewise, it is necessary to have independent judges, free of external and internal pressures, so that they issue their decisions with no more attachment than compliance with the provisions of the laws based on the facts that constitute the basis of the litigation and the evidence produced in the trial stage so that the court is objectively legitimized to issue fair, democratic resolutions consistent with the demands raised by the parties. La impartición de justicia es una de las funciones más trascendentes del estado moderno, donde un órgano especializado dirime aquellas controversias que le plantean los ciudadanos, aplicando normas jurídicas de carácter general a un caso particular, para resolver la discordia que plantean las partes, emitiendo su resolución en forma objetiva, justa, equitativa, imparcial e independiente.  Para que el Estado mexicano garantice la emisión de sentencias justas y equitativas, es necesario que a la vez se garantice el cumplimiento de una serie de presupuestos en el desarrollo de la actividad jurisdiccional, entre los cuales destaca la necesidad de lograr especialización de jueces y magistrados y brindarles la oportunidad de una capacitación permanente y adecuada a la labor que desempeñan. Asimismo, se requiere contar con jueces independientes, libres de presiones exteriores e interiores, para que emitan sus decisiones sin más apego que al cumplimiento de lo dispuesto por las leyes con base en los hechos que constituyen la base de la litis y las pruebas producidas en la etapa de juicio para que el tribunal este objetivamente legitimado a emitir resoluciones justas democráticas y congruentes con las demandas planteadas por las partes.
