In this sense, this article seeks to exhibit the contradictions that presents the current discourse of human rights within the framework of the recognition of diversity, as well as opening new lines of research around the object of study. The methodology used is based on qualitative analysis, centered on the review of documentary resources from international organizations, specialized bibliography and representative judicial decisions emerge. The results obtained show an interpretative trend of human rights, in which the justification of axiological guidelines that transform rights and a dogmatic approach to human rights coexist. La adscripción de la diversidad en un marco universalista de derechos humanos ha revelado ciertas deficiencias en la atención a las violaciones de derechos específicos de grupos diversos entre los que se distinguen los pueblos y comunidades indígenas. En este sentido, el presente artículo busca exhibir las contradicciones que presenta el discurso actual de los derechos humanos en el marco del reconocimiento de la diversidad, así como abrir nuevas vertientes de investigación en torno al objeto de estudio. La metodología utilizada se basa en el análisis cualitativo, a partir de la revisión de recursos documentales desde el que se desprenden informes de organismos internacionales, bibliografía especializada y resoluciones judiciales representativas. Los resultados obtenidos muestran una tendencia interpretativa de derechos humanos, en la que coexiste la justificación de pautas axiológicas transformadoras de derechos y un enfoque dogmático de derechos humanos.
