And the negative effect this failure had on the possible implementation of a transitional justice process in Mexico. To this end, Niklas Luhmann’s Theory of Social Systems is used to analyze the way in which the rights of victims are linked to the system of law and, in particular, to transitional justice, and to understand the limits of the Foros Escucha. A bibliographical, documentary and hemerographic review has been carried out for the development of forums, as well as of the definition and evolution at the international level of transitional justice and the rights of victims. Among the main results highlights the contradiction of the expectations that family organizations and groups had, those of the team that organized the forums and those of the president-elect would have to define a policy of reconciliation through transitional justice. El trabajo se enfoca en analizar los elementos que condujeron al fracaso de los foros escucha para trazar la ruta de pacificación del país y la reconciliación nacional impulsados en el 2018 por el entonces presidente electo, Andrés Manuel López Obrador. Y el efecto negativo que este fracaso tuvo en la posible implementación de un proceso de Justicia Transicional en México. En este sentido, se emplea la Teoría de los Sistemas Sociales de Niklas Luhmann que permite analizar la forma en que los derechos de las víctimas se vinculan al sistema de derecho y, sobre todo, a la justicia transicional, y con ello, comprender los límites de los Foros Escucha. Se ha realizado una revisión bibliográfica, documental y hemerográfica del desarrollo de los foros, así como de la definición y evolución a nivel internacional de la justicia transicional y de los derechos de las víctimas. En los principales resultados destaca la contradicción de las expectativas que tenían las organizaciones y colectivos de familiares, las del equipo que organizaba los foros y las del presidente electo a la influencia tendrían para definir una política de reconciliación mediante la justicia transicional.
