In Mexico, labor relations between individuals and workers in the service of the State are regulated in article 123, sections A and B, of the Political Constitution of the United Mexican States; they derive from this, laws through which it is intended to provide protection to victims of mobbing. In the development of the topic, it seeks to demonstrate the probable existence of mobbing in the context of the work. From the, it derives the importance of legislators clarifying and establishing parameters of protection in the matter, against actions that may arise in the violation of human dignity and the use of the power of dominion of one person over another. In the research, the qualitative method of deductive and phenomenological, using the laws, testimonies, expert judgment, popular science articles and publications on Internet. La presente investigación se desarrolla en el marco legal que regula al mobbing en México y la definición del concepto, partiendo de una perspectiva mexicana; así mismo, trata de identificar si en su existencia, las leyes citadas se contienen las características de este, además de conocer si tiene relevancia la profesión, la edad o el género de la víctima. En México, las relaciones laborales entre particulares y trabajadores al servicio del Estado se encuentran reguladas en el artículo 123, apartados A y B, de la Constitución Política de los Estados Unidos Mexicanos; derivan de esta, leyes mediante las cuales se intenta brindar protección a víctimas del mobbing. En el desarrollo del tema, se busca demostrar la probable existencia del mobbing en el contexto del trabajo. De lo antes mencionado, deriva la importancia de que los legisladores clarifiquen y establezcan parámetros de protección en la materia, contra de actuaciones que puedan surgir en la violación a la dignidad humana y el uso del poder de dominio de una persona respecto de otra. En la investigación, se utilizó el método cualitativo de enfoque deductivo y fenomenológico, utilizando las leyes, testimonios, juicio de experto, artículos de divulgación científica y publicaciones en internet.
