This research article deals with three points that are: the elements within the legal relationship, public administration and digital government in the scope of the state of Nuevo León and Chiapas; the consequences of the change in public management from public administration to digital government and analyze the change from electronic government to digital government. This topic is relevant for the construction of an effective digital public administration. It is part of the objectives of the research work called "The Centralized Public Administration of the State of Nuevo León, as a model of good governance within the framework of ICT", PROMEP 511-6/2020-7847, Mexico, SEP, 2020-2021. For the interference of the observance of digitalization within the transformation of public administration and its implications, the analytical methodology is used that allows observing the problem, proposing a solution to it, and obtaining the conclusion of the adaptation of the technology in the modification of the parameters of public administration. La tecnología ha implicado un movimiento dentro de la estructura de la administración pública, toma mayor fuerza hacia la digitalización de las funciones y logra la interrelación de la participación de los administrados para cumplir con sus obligaciones, requerimientos, y necesidades; es una forma de gestión pública tendiente a mejorar la comunicación de una manera directa. Este artículo de investigación versa en tres puntos que son: los elementos dentro de la relación jurídica, administración pública y gobierno digital en el ámbito del estado de Nuevo León y Chiapas; las consecuencias que lleva el cambio de la gestión pública de la administración pública hacia el gobierno digital y analizar el cambio del gobierno electrónico hacia el gobierno digital. Este tema es relevante para la construcción de una administración pública digital eficaz. Forma parte de los objetivos del trabajo de investigación denominado “La administración pública Centralizada del Estado de Nuevo León, como modelo de buen gobierno en el marco de las TIC”, PROMEP 511-6/2020-7847, México, SEP, 2020-2021. Para la injerencia de la observancia de la digitalización dentro de la transformación de la administración pública y sus implicaciones se utiliza la metodología analítica que permite observar el problema, proponer una solución al mismo, y obtener la conclusión de la adaptación de la tecnología en la modificación de los parámetros de la administración pública.
