It is analyzed how, due to the absence of regulations in social networks in electoral matters, the Jurisdictional Authority has overcome these challenges, through interpretations that seek to provide a balance between rights and democratic principles, reaching the conclusion that there are legal challenges for the imposition of sanctions. that violate equity in electoral contests by influencers such as the legal definition of said figure, the study of spontaneity in support of an ideology or candidate and the application of limits to freedom of expression in social networks. The objective of the research is to analyze how the right to freedom of expression of ideas is interpreted in social networks, through the figure of the influencer in the electoral field. El presente trabajo de investigación aborda el ejercicio de la libertad de expresión como parte fundamental en la vida democrática y, cómo dentro del ejercicio de dicha prerrogativa en los procesos electorales, aparece la figura del influencer, en calidad de nueva figura de transmisión de ideas políticas. Se analiza cómo en razón de una ausencia de normatividad en redes sociales en materia electoral, la Autoridad Jurisdiccional ha superado esos retos, mediante una interpretación que pretende dar un equilibrio entre derechos y principios democráticos, llegando a concluir que existen retos legales para la imposición de sanciones, que vulneran la equidad en contiendas electorales por parte de los influencers, como lo es, la definición legal de dicha figura, el estudio de una espontaneidad en apoyo a una ideología o candidato y, la aplicación de límites a la libertad de expresión en redes sociales. El objetivo de la investigación es analizar, cómo es interpretado el derecho de la libertad de expresión de ideas en redes sociales, a través de la figura del influencer en el ámbito electoral.
