| Yhteenveto: | This research work addresses the exercise of freedom of expression as a fundamental part of democratic life and how, within the exercise of said prerogative in electoral processes, the figure of the “Influencer” appears as a new figure for the transmission of political ideas.
It is analyzed how, due to the absence of regulations in social networks in electoral matters, the Jurisdictional Authority has overcome these challenges, through interpretations that seek to provide a balance between rights and democratic principles, reaching the conclusion that there are legal challenges for the imposition of sanctions. that violate equity in electoral contests by influencers such as the legal definition of said figure, the study of spontaneity in support of an ideology or candidate and the application of limits to freedom of expression in social networks.
The objective of the research is to analyze how the right to freedom of expression of ideas is interpreted in social networks, through the figure of the influencer in the electoral field. |
