This paper aims to incorporate to this legal discussion some psychological elements to guide the understanding of this concept, its relation with the autonomy of the will and, as a consequence, the adequate kind of governmental intervention. Based on Joaquín Dualde’s ideas, I affirm that consent is the cause of contracts, and that the Law should look at the causes of such cause, that is to say, those elements and events which when manifested, configure the contract. I analyze the irrational elements of this configuration and, finally, based upon the Humanistic Psychology perspective and the individuation principle proposed by Carl Jung, I consider the possibility of effectively strengthening the effective freedom of people. El concepto de causa contractual ha sido inadecuadamente abordado desde Domat, generándose un estado de ininteligibilidad y de posiciones doctrinales que defienden que la causa es irrelevante, excluyéndola del pensamiento jurídico, o que es lo único relevante, con la que se justifican niveles excesivos de intervención en el mercado. Este trabajo busca incorporar en la discusión jurídica elementos psicológicos que orienten la comprensión de dicho concepto, su relación con la autonomía de la voluntad como categoría jurídica y, en consecuencia, el tipo de intervención estatal adecuado. A partir de las ideas de Joaquín Dualde, sostengo que el consentimiento es la causa de los contratos, y que el interés del derecho debe orientarse a las causas del consentimiento, esto es, a los elementos y eventos que configuran esa voluntad cuya manifestación perfecciona el contrato. Se analizan los elementos irracionales en esta configuración, y finalmente se estudia, a partir del Enfoque Humanista de la psicología y del principio de individuación propuesto por Carl Jung, la posibilidad de fortalecer la libertad efectiva de los sujetos jurídicos.
