Los Juicios Orales nacen en la Constitución Política de los Estados Unidos Mexicanos el 19 de junio de 2008, en virtud de haberse reformado diversos artículos relacionados con el sistema penal integral; sin embargo, el nuevo modelo de sistema procesal penal acusatorio entrará en vigor cuando lo establezca la legislación secundaria correspondiente, sin exceder el plazo de ocho años, contados a partir de la fecha antes mencionada.
